These Terms govern all charters booked with Unda mora d.o.o. By paying the first instalment, the Client confirms acceptance of these Terms in full.
1. Definitions
- "Company" means Unda mora d.o.o., incorporated under the laws of the Republic of Croatia. Director: Vedran Šubić. Starogradska ulica 10, 48000 Koprivnica, Croatia. OIB: HR16554176249.
- "Charter Agreement" — binding contract formed upon booking acceptance and receipt of the deposit.
- "Client" — the lead-named person acting on behalf of all charter participants.
- "Charter Fee" — the base vessel fee per booking confirmation, excluding APA and extras.
- "APA" — Advance Provisioning Allowance; a pre-paid fund for provisioning, fuel, and port dues.
- "Vessel" — the yacht confirmed in the Charter Agreement.
- "Crew" — the captain and crew assigned by the Company.
- "Charter Period" — embarkation to disembarkation dates per the booking confirmation.
2. Booking & Confirmation
- Enquiries may be made via our website or email. A booking is not confirmed until written confirmation has been issued and the first instalment received.
- The Client must be of legal age and authorised to bind all guests to these Terms.
- Special requirements (dietary, medical, accessibility) must be declared at the time of booking.
3. Payment Schedule

- Failure to pay on schedule entitles the Company to cancel the reservation.
- Payment by bank transfer to account details provided in the booking confirmation.
- By paying the first instalment, the Client agrees to these Terms in full.
4. APA — Advance Provisioning Allowance
- APA of 25% of the Charter Fee is collected at embarkation in cash or by card.
- Used for: fuel, port dues, provisioning, transit logs, tourist tax, and extras.
- The captain maintains a transparent running account. Unused APA is returned at disembarkation.
- If APA is exhausted mid-charter, the Client agrees to top up on request.
5. Cancellation by Client

- Cancellation must be submitted in writing to the Company.
- The date of receipt of written cancellation is the basis for calculation.
- The Company will endeavour to rebook the vessel for the cancelled period; if successful, a partial refund may be issued at the Company's discretion.
- Travel insurance covering cancellation is strongly recommended.
6. Cancellation by Company
- The Company reserves the right to cancel in cases of force majeure, unsafe vessel condition, or regulatory prohibition.
- In the case of Company cancellation, all payments made shall be refunded in full within 14 days.
- The Company's liability is limited to the refund of amounts paid; no consequential losses shall be compensated.
7. Charter Conditions & Vessel Use
- The Vessel shall be used only for private recreational purposes in compliance with Croatian maritime law.
- The Vessel shall not be used for commercial purposes, subleasing, racing, or illegal activities.
- The Client shall respect all port authority regulations and Croatian maritime law.
- Maximum guest numbers per vessel must not be exceeded.
- Pets are not permitted unless specifically agreed in writing.
- Smoking is permitted only in designated outdoor areas.
- The Client is responsible for any damage caused by negligence or misuse beyond normal wear and tear.
8. Crew & Captain's Authority
- The captain has ultimate authority over vessel safety, navigation, and routing.
- The captain may alter or abandon the itinerary at any time for reasons of safety, weather, or force majeure. No refund is due for itinerary changes made in the interests of safety.
- The captain may refuse embarkation or require disembarkation of any guest who poses a risk to vessel safety or crew/guest welfare.
- Crew working hours are governed by Croatian maritime regulations.
9. Security Deposit
- A security deposit is required at embarkation by credit card pre-authorisation or cash. The amount varies by vessel and will be stated in the booking confirmation (typically €2,000–€3,000).
- The deposit covers potential damage to the vessel, equipment, or marina infrastructure.
- The deposit is returned within 7 days of disembarkation, less any agreed deductions.
10. Insurance
- The Vessel carries hull and liability insurance as required by Croatian law.
- Charter insurance does not cover guests' personal belongings, travel cancellation, or medical expenses.
- Guests are strongly advised to arrange personal travel and medical insurance prior to departure.
11. Force Majeure
- Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including: natural disasters, pandemic, war, government action, extreme weather, or maritime authority orders.
- In force majeure events, the Company will offer rebooking to an alternative date at no penalty, or a credit note valid for 24 months.
12. Liability
- The Company's total liability shall not exceed the total Charter Fee paid.
- The Company is not liable for loss of enjoyment, personal injury, or property loss caused by factors beyond its control.
- Nothing in these Terms limits liability for death or personal injury caused by Company negligence.
13. Complaints & Disputes
- Complaints during a charter must be reported immediately to the captain or the Company.
- Written complaints must be submitted within 14 days of disembarkation.
- These Terms are governed by the laws of the Republic of Croatia.
- Any dispute shall be subject to the jurisdiction of the competent court in Split, Croatia.
14. Data Protection
- Client data is processed in accordance with our Privacy Policy and the GDPR as applicable.
